These Terms & Conditions apply to purchases made through the website of Stéphanie Poppe and to the use of this website. By placing an order through the website, the customer acknowledges having read and accepted these Terms & Conditions.

Hereafter referred to as “Stéphanie Poppe”, “the Studio”, “we”, “us” or “the Seller”.
2. Scope
These Terms & Conditions apply to all offers, orders and purchases made through www.stephaniepoppe.com, unless otherwise expressly agreed in writing.
The online shop primarily offers original artworks, works on paper, limited editions, art prints, hand-finished or hand-enhanced works and, where applicable, other artistic objects created or offered by Stéphanie Poppe.
For commissions, restoration services, bespoke projects, collaborations or other services not purchased directly through the online shop, separate quotations and/or specific contractual conditions may apply.
3. Artworks and Product Information
Every effort is made to describe and photograph each artwork as accurately as possible, including its dimensions, materials, techniques, edition information and framing where applicable.
However, colours and details may vary slightly depending on screen settings, photography, lighting and the handmade nature of the work.
Many artworks contain handmade elements and natural or artisanal materials. Slight irregularities, variations in paper, ink, pigment, thread, texture, surface or finish are inherent to the artistic process and form part of the individual character of the work. They are not considered defects.
Where an artwork is part of a limited edition, the edition size and other relevant information will be indicated in the product description where applicable.
Unless explicitly stated otherwise, artworks are sold as described on their individual product page.
4. Prices
All prices displayed on the website are in euros (€).
Prices include applicable taxes where required by law, unless explicitly stated otherwise.
Where indicated in the product description or checkout process, the listed price may also include professional packaging, handling and/or shipping. Any additional costs applicable to an order will be clearly communicated before the customer confirms the purchase.
For deliveries outside the European Union, import duties, customs charges, local taxes or other fees may be imposed by the destination country. Unless explicitly stated otherwise, these costs are the responsibility of the customer and are not included in the purchase price.
Stéphanie Poppe reserves the right to change prices at any time. The price applicable to an order is the price displayed and confirmed at the time the order is placed.
5. Orders
An order is considered final once the customer has completed the ordering process and payment has been successfully received or otherwise confirmed.
After placing an order, the customer will receive an order confirmation by email.
The Seller reserves the right to refuse or cancel an order in exceptional circumstances, including but not limited to an obvious pricing or technical error, suspected fraudulent activity, incorrect product information or the unexpected unavailability of an artwork.
If an order that has already been paid cannot be fulfilled, the customer will be informed and the amount paid will be refunded.
6. Payment
Payment must be made using one of the payment methods offered during checkout.
Orders will only be prepared for shipment once payment has been successfully received, unless otherwise agreed in writing.
All transactions are subject to the terms and security procedures of the relevant payment provider.
7. Packaging and Delivery
Artworks are handled with care and professionally packed using materials and methods appropriate to the nature, dimensions and fragility of the work.
Orders are shipped to the delivery address provided by the customer during checkout. The customer is responsible for ensuring that this information is complete and correct.
Estimated delivery times are indicative and may vary depending on the destination, the dimensions or nature of the artwork, the selected carrier and circumstances beyond the Seller’s reasonable control.
Where tracking information is available, it will be provided to the customer.
The Seller cannot be held responsible for delays caused by carriers, customs procedures, force majeure or other circumstances beyond reasonable control. This does not affect any mandatory consumer rights concerning delivery.
8. Inspection Upon Delivery and Transport Damage
Customers are advised to inspect the packaging and artwork promptly upon delivery.
If an artwork arrives visibly damaged, the customer should contact info@stephaniepoppe.com as soon as reasonably possible and provide:
- the order number;
- a description of the damage;
- clear photographs of the external packaging;
- photographs of the internal packaging; and
- photographs of the artwork and the damage concerned.
Customers are requested to retain all original packaging until the matter has been resolved, as this may be required for a claim with the carrier or insurer.
Nothing in this section limits the customer’s statutory consumer rights.
9. Right of Withdrawal and Returns
If the customer qualifies as a consumer under applicable Belgian and European consumer law, the customer generally has the right to withdraw from an online purchase within 14 days from the day on which the customer, or a third party designated by the customer, receives the goods, without having to provide a reason, subject to the exceptions provided by law.
To exercise the right of withdrawal, the customer must inform Stéphanie Poppe of the decision to withdraw by means of a clear written statement sent to info@stephaniepoppe.com before the withdrawal period expires.
After notifying the Seller, the customer must return the artwork within the legally applicable period.
Unless otherwise required by law or agreed by the Seller, the direct cost and responsibility for returning the artwork are borne by the customer. Because artworks may be fragile or valuable, they must be returned securely and, wherever reasonably possible, using the original protective packaging.
The customer is responsible for any diminished value resulting from handling the artwork beyond what is necessary to establish its nature, characteristics and condition.
Refunds will be made in accordance with applicable consumer law and using the same payment method used for the original transaction, unless otherwise expressly agreed.
Exceptions
The statutory right of withdrawal does not apply where an applicable legal exception exists. This may include, among other cases, goods made to the customer’s specifications or clearly personalised for the customer.
Where an artwork, frame, inscription, commission or other item is specifically created or personalised at the customer’s request and falls within such a statutory exception, this will be communicated where appropriate before the order is finalised.
This does not affect the customer’s legal rights in the event of defective, damaged or incorrectly supplied goods.
10. Original and Unique Artworks
Original artworks and unique pieces are one-of-a-kind objects. Once an original artwork has been sold, it may no longer be available.
The sale of a physical original artwork transfers ownership of that physical object only. It does not transfer copyright, reproduction rights or other intellectual property rights relating to the artwork.
11. Limited Editions and Certificates of Authenticity
Where applicable, limited-edition and original artworks may be signed, numbered and/or accompanied by a Certificate of Authenticity.
A Certificate of Authenticity forms part of the documentation of the artwork and should be retained by the purchaser.
Edition numbers may be allocated according to the Studio’s internal administration and are not necessarily sold in numerical order unless expressly stated otherwise.
12. Copyright and Intellectual Property
All artworks, photographs, texts, illustrations, designs, graphics, logos and other creative content appearing on this website are protected by applicable copyright and intellectual property laws.
Unless expressly agreed otherwise in writing, all intellectual property rights remain the exclusive property of Stéphanie Poppe or the respective rights holder.
Purchasing an artwork does not grant the purchaser the right to reproduce, publish, distribute, commercially exploit, modify or create derivative works from the artwork.
Images of purchased artworks may not be used for commercial, promotional, merchandising or reproduction purposes without prior written permission.
Reasonable private display and personal use of the physical artwork are, of course, permitted.
13. Resale and Provenance
The purchaser is encouraged to retain invoices, Certificates of Authenticity and any other documentation accompanying an artwork, as these documents may be relevant to its provenance.
Nothing in these Terms & Conditions restricts any rights the purchaser may have under applicable law regarding the resale of a lawfully purchased physical artwork.
Copyright and other intellectual property rights remain unaffected by any subsequent resale of the physical work.
14. Legal Guarantee and Conformity
Consumers benefit from the statutory rights and guarantees provided under applicable Belgian consumer law.
If an artwork or product does not conform to the agreement or presents a defect covered by the applicable statutory guarantee, the customer should contact info@stephaniepoppe.com with the order details and relevant photographs or information.
The handmade character, artistic variations, natural material characteristics or minor differences in colour or texture described on the product page do not in themselves constitute a lack of conformity.
Nothing in these Terms & Conditions excludes or limits any mandatory statutory guarantee or consumer right.
15. Care of Artworks
Paper, textile, ink, pigment and other artistic materials can naturally react to environmental conditions over time.
Unless otherwise indicated, artworks should be protected from excessive humidity, moisture, heat and prolonged exposure to direct sunlight. Appropriate professional framing and conservation-grade materials are recommended where relevant.
The Seller cannot be held responsible for deterioration or damage resulting from improper handling, storage, installation, cleaning, framing or environmental conditions after delivery.
16. Website Information and Availability
The Seller makes reasonable efforts to ensure that information on the website is accurate and up to date.
Occasional typographical errors, technical errors, temporary interruptions or inaccuracies may nevertheless occur. The Seller reserves the right to correct such errors and update website content where necessary.
The availability of the website or online shop cannot be guaranteed without interruption.
17. Privacy and Cookies
Personal information collected through the website is processed in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR).
Further information regarding cookies and similar technologies can be found on the website’s Cookie Policy page.
Personal information provided in connection with an order will only be used as necessary to process the transaction, fulfil the order, communicate with the customer and comply with legal or administrative obligations, subject to the applicable privacy policy.
18. Liability
To the extent permitted by law, Stéphanie Poppe shall not be liable for indirect or consequential losses resulting from the use of the website or the purchase, handling or display of an artwork.
Nothing in these Terms & Conditions excludes or restricts liability where such exclusion or restriction is prohibited by applicable law.
19. Force Majeure
The Seller shall not be liable for delays or failure to perform obligations resulting from circumstances beyond reasonable control, including but not limited to natural disasters, strikes, transport disruptions, customs delays, governmental measures, war, civil unrest, epidemics, failures of communication or payment systems, or other events of force majeure.
Where such circumstances materially affect an order, the Seller will make reasonable efforts to inform the customer and find an appropriate solution.
20. Changes to These Terms & Conditions
These Terms & Conditions may be updated from time to time to reflect changes to the website, business activities or applicable legislation.
The Terms & Conditions applicable to a purchase are those in force at the time the order is placed.
21. Governing Law and Disputes
These Terms & Conditions and any agreement concluded through this website are governed by Belgian law, without prejudice to any mandatory consumer protection provisions applicable to customers residing in another jurisdiction.
In the event of a complaint or dispute, customers are encouraged to first contact Stéphanie Poppe at info@stephaniepoppe.com so that an amicable solution can be sought.
If no amicable solution can be reached, disputes may be submitted to the competent courts in accordance with applicable Belgian and European law.
